COASTAL TOUR LTD

CAR RENTAL TERMS AND CONDITIONS
(Mauritius)

These Terms and Conditions govern all vehicle rental services provided by Coastal Tour Ltd (“we”, “us”, “our”), a company operating in the Republic of Mauritius. By making a reservation, signing a rental agreement, or taking possession of a vehicle, the renter (“you”, “the renter”, or “the driver”) confirms that they have read, understood, and agreed to be bound by these Terms and Conditions.

1. Definitions

For the purposes of these Terms and Conditions, the “Vehicle” refers to any motor vehicle rented by Coastal Tour Ltd. The “Rental Period” refers to the period commencing at the time the vehicle is collected and ending at the agreed time and date of return. The “Renter” is the person who signs the rental agreement and assumes full financial responsibility for the vehicle. The “Driver” refers to any person authorised to drive the vehicle under the rental agreement. The “Excess” refers to the maximum amount payable by the renter in the event of damage, loss, or theft of the vehicle.

2. Rental Eligibility and Driver Requirements

The renter and any authorised driver must be at least twenty-one (21) years of age unless otherwise agreed in writing. All drivers must hold a valid driving licence that has been issued for a minimum of one (1) year. Foreign driving licences are accepted in Mauritius; however, an International Driving Permit may be required. Only drivers declared and approved at the time of rental are permitted to drive the vehicle.

3. Booking and Payment

All reservations are subject to vehicle availability. Coastal Tour Ltd reserves the right to request full payment or a deposit prior to or at vehicle collection and may refuse a rental if valid documentation or payment cannot be provided.

4. Security Deposit

A refundable security deposit of USD 550 or MUR 25,000 is required at the time of rental and must be paid prior to vehicle collection. The deposit is held as security against damages, loss, traffic fines, fuel shortages, late returns, cleaning fees, or any other breach of these Terms and Conditions. Should the renter be found liable for any damage or cost incurred during the rental period, the corresponding amount shall be deducted from the deposit. Any remaining balance shall be refunded within three (3) to ten (10) working days after return of the vehicle, subject to inspection and bank processing times. Coastal Tour Ltd reserves the right to recover additional costs should they exceed the deposit amount.

5. Vehicle Collection and Return

The vehicle must be collected and returned at the agreed date, time, and location. Late returns may result in additional charges. The vehicle must be returned in the same condition as collected, fair wear and tear excepted.

6. Fuel Policy

Vehicles are supplied with a specified fuel level and must be returned with the same level. Missing fuel will be charged at the prevailing rate plus a service fee.

7. Mileage and Usage Restrictions

Mileage limits, if applicable, are stated at booking. The vehicle must not be used for illegal purposes, off-road driving, racing, towing, or commercial transport without authorisation. Vehicles must not be taken outside Mauritius without written consent.
8. Insurance and Liability
Vehicles are insured in accordance with Mauritian law. Insurance does not cover negligent or unlawful use, driving under the influence, or unauthorised drivers. The renter remains liable up to the excess amount.

9. Accidents, Damage, and Theft

All accidents, damage, or theft must be reported immediately to Coastal Tour Ltd and the police. A police report is mandatory. Failure to comply may result in full liability.

10. Traffic Fines

The renter is responsible for all traffic fines incurred during the rental period. An administration fee may apply.

11. Cancellations and No-Shows

Cancellation policies depend on the booking conditions. No-shows or late cancellations may incur charges. Non-refundable bookings are not eligible for refunds.

12. Late Returns and Extensions

Extensions require prior approval. Unauthorised extensions may invalidate insurance and incur additional charges.

13. Breakdown and Replacement

In the event of mechanical breakdown not caused by misuse, assistance will be provided subject to availability.

14. Limitation of Liability

Coastal Tour Ltd shall not be liable for loss of personal belongings or indirect or consequential losses. Liability shall not exceed the total rental amount paid.

15. Privacy and Data Protection

Personal data is processed in accordance with applicable data protection laws in Mauritius and with internationally recognised data protection principles.

16. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Mauritius. The courts of Mauritius shall have exclusive jurisdiction.
